Terms of Service

These terms describe the basic conditions for using Falaq Pixel, including merchant responsibilities, acceptable use, limits, and Kuwait governing law.

Provider

Falaq Pixel is provided under the Falaq Solutions trade name. The Arabic legal name is شركة فلق العالمية لإدارة المشاريع. The English legal name is still to be confirmed where required for formal contracting.

Service

Falaq Pixel helps merchants collect, normalize, and route ecommerce events to advertising and marketing platforms they configure. The service depends on merchant configuration, third-party platform availability, browser behavior, network conditions, and platform policy changes.

We may update, modify, suspend, or discontinue parts of the service as needed to operate it, comply with law, or respond to platform requirements.

Merchant responsibilities

Merchants are responsible for:

  • Providing accurate account, store, and configuration information.
  • Maintaining their own customer notices, cookie disclosures, consent flows, and lawful basis for the data they send through Falaq Pixel.
  • Ensuring their use of advertising and marketing destinations complies with applicable laws and platform terms.
  • Reviewing event payloads and destination settings before enabling production traffic.
  • Keeping access credentials, admin passwords, and connected accounts secure.

Acceptable use

Merchants may not use Falaq Pixel to send unlawful data, infringe third-party rights, interfere with the service, bypass security controls, reverse engineer non-public parts of the service, or overload the service with traffic unrelated to normal ecommerce operations.

Third-party platforms

Falaq Pixel integrates with third-party platforms such as advertising networks, marketing platforms, hosting providers, and database providers. These platforms are not controlled by Falaq Solutions. Their terms, APIs, privacy policies, outages, and policy decisions may affect the service.

Fees

Fees, billing periods, usage limits, and overage terms are governed by the merchant's order, subscription, marketplace listing, or written agreement with Falaq Solutions. Taxes, chargebacks, and payment processor fees may apply where relevant.

No professional advice

Falaq Pixel is a technical event-routing service. It does not provide legal, tax, accounting, or advertising compliance advice. Merchants should consult qualified advisors for those matters.

Disclaimers

The service is provided as available and as permitted by law. We do not promise uninterrupted operation, error-free delivery, specific attribution results, advertising performance, or continued availability of any third-party integration.

Limitation of liability

To the extent permitted by law, Falaq Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from use of the service.

Governing law

These terms are governed by the laws of Kuwait, without regard to conflict-of-law rules. Courts or competent authorities in Kuwait will have jurisdiction unless a mandatory law requires another forum.

Changes

We may update these terms as the service changes. Continued use after an update means the merchant accepts the revised terms.
